Mr. Cuff – Terms and Conditions of Sale (Bespoke & Made-to-Measure)
Definitions
- Mr. Cuff: Refers to Mr. Cuff (ABN 25 323 708 300), located in Melbourne, Victoria, Australia.
- Client: Refers to the individual or entity purchasing made-to-measure goods from Mr. Cuff.
- Goods: Refers to the made-to-measure items, including but not limited to shirts, suits, trousers, and other apparel, ordered by the Client from Mr. Cuff.
- Made-to-Measure: Refers to Goods that are specifically created and tailored to the Client’s individual measurements and specifications.
- Final Fitout: Refers to the final fitting session where the Client tries on the completed Goods for assessment and confirmation of fit. This may occur in person or via mutually agreed upon remote methods (e.g., video call with photographic evidence).
- Confirmation: Refers to the Client’s explicit approval, provided after the Final Fitout, indicating that the Goods are satisfactory and meet their agreed-upon specifications and fit. This Confirmation may be verbal, written (including email), or via other documented means.
- Post Events: Refers to the period after the Final Fitout and Confirmation, when the Goods have been worn or used by the Client.
- Victorian Consumer Affairs: Refers to Consumer Affairs Victoria, the consumer protection agency in Victoria, Australia, which administers the Australian Consumer Law (ACL).
Ordering and Specifications
- The Client is responsible for providing accurate measurements and specifications for the Made-to-Measure Goods. Mr. Cuff is not liable for inaccuracies in measurements or specifications provided by the Client.
- Mr. Cuff will use reasonable care and skill to create the Goods according to the Client’s specifications. However, minor variations due to the bespoke nature of the Goods are possible and acceptable.
- Any modifications or changes to the original order requested by the Client after the initial order placement may be subject to additional charges and production timelines, at the discretion of Mr. Cuff.
Final Fitout and Confirmation
- Once the Made-to-Measure Goods are nearing completion, Mr. Cuff will arrange a Final Fitout with the Client.
- The Client is responsible for attending the Final Fitout (in person or via agreed remote methods) and thoroughly assessing the fit and overall quality of the Goods.
- Upon completion of the Final Fitout, the Client will provide explicit Confirmation that the Goods are satisfactory. This Confirmation signifies the Client’s acceptance of the Goods.
Returns and Refunds
- Due to the nature of our Bespoke and Made-to-Measure Goods, which are created to your individual specifications, Mr. Cuff does not offer refunds or accept returns after the Final Fitout and Confirmation have been provided by the Client, particularly for issues arising after the Goods have been worn or used (Post Events).
- This policy is in place because the Goods have been specifically tailored for you, and as such, cannot be resold or altered for other customers.
- This policy does not affect your statutory rights under the Australian Consumer Law, which provides guarantees for goods and services.
Consumer Guarantees under the Australian Consumer Law
- Our Goods come with guarantees that cannot be excluded under the Australian Consumer Law, as administered by Victorian Consumer Affairs. You are entitled to have the Goods repaired or replaced if the Goods fail to be of acceptable quality and the failure does not amount to a major failure.
- Acceptable quality means that the Goods must be:
- Fit for all the purposes for which goods of that kind are commonly supplied. For example, a shirt should be wearable as clothing.
- Acceptable in appearance and finish. The garment should be free from significant defects in its construction and appearance.
- Free from defects. There should be no inherent flaws in the materials or workmanship.
- Safe. The garment should not pose any unreasonable safety risks when worn.
- Durable. Considering the type of garment and its intended use, it should be reasonably long-lasting.
- In the unlikely event that the Goods have a manufacturing defect that was not apparent during the Final Fitout, or do not meet the consumer guarantees under the ACL, the Client should notify Mr. Cuff in writing with photographic evidence as soon as reasonably possible after discovering the issue.
- Mr. Cuff will assess any reported issues and, if deemed a valid claim under the ACL, will work with the Client to provide a suitable remedy, such as repair, alteration to rectify the issue (if feasible), or replacement (at Mr. Cuff’s discretion), in accordance with your rights under the Australian Consumer Law.
Limitation of Liability
- Mr. Cuff is not liable for any indirect, consequential, or economic loss or damage.
Governing Law
- These Terms and Conditions shall be governed by and construed in accordance with the laws of Victoria, Australia, and the Australian Consumer Law as applicable in Victoria.
Entire Agreement
- These Terms and Conditions constitute the entire agreement between Mr. Cuff and the Client regarding the sale of bespoke and made to measure Goods and supersede all prior discussions, agreements, or understandings.
